Non-Exclusive Commercial License Terms
A non-exclusive commercial license grants the Licensee direct manufacture and sale of physical goods. Physical goods include but are not limited to stationery, apparel, footwear, accessories, notebooks, greeting cards, stickers, packaging, mugs, candles, posters, signage, wallpaper, home decor and kitchenware.
The license is non-exclusive. The same artwork may be licensed concurrently to other parties. Where exclusivity within a product category and territory is required, see exclusive licensing.
Copyright and ownership are retained by Media Jamshidi. The Licensee receives usage rights only.
Grant
500 units or 500 m², two years. Manufacture and sale of up to 500 units of physical goods, or up to 500 square meters of fabric, textile or wallpaper, for two years from the date of purchase.
Unlimited units, three years. Unlimited manufacture and sale of physical goods, or unlimited square meters of fabric, textile or wallpaper, for three years from the date of purchase.
Either measure satisfies the license. Commercial use includes promotion of a business, product or service, for example through corporate gifts.
Term and re-licensing
The term runs from the date of purchase. On expiry the Licensee may choose to license the artwork again, at the rate current at that time. Continued manufacture or sale after expiry requires a current license.
Restrictions
Any use not expressly granted above is prohibited. Written permission must be obtained for any use case not clearly covered.
Non-transferable. The license is personal to the individual or entity named at the time of purchase. Vendors or manufacturers acting on the Licensee's behalf may use the artwork solely to produce the Licensee's finished goods. Transfer, assignment or sub-licensing is prohibited.
Digital products. Use of the artwork in digital, non-tangible or digitally distributable products for commercial purposes is prohibited, including designs, social media assets, online advertising, website elements, applications, device wallpapers and digital publications.
Print on demand and made to order. Any use permitting a third party or end customer to customize a product with the artwork is prohibited, including services such as Zazzle, Redbubble, Society6 and Spoonflower and any platform operating a comparable model.
Distribution of the artwork. The artwork may not be published, posted or shared in its original form at any resolution, on any channel, including in promotion of goods manufactured under license. No use may permit a third party to download, screenshot, extract or redistribute the artwork as a standalone file.
Direct manufacture only. The Licensee must be the final manufacturer of the goods bearing the artwork. Manufacture and wholesale distribution of textiles or raw materials for onward manufacture by others is prohibited.
Resale and sub-licensing. Resale or sub-licensing of the artwork, or of any modification of it, in a manner competing directly with the original, is prohibited.
Trademark. The artwork may not form part of a trademark. The Licensee may not seek to register, protect or enforce trademark or comparable rights in it.
Copyright. The Licensee may not claim the artwork, or any modification of it, as its own copyrighted work. The original must be disclaimed in any copyright registration.
Attribution. Representation of the Licensee as author or owner of the artwork is prohibited.
